The Design Procademy website, products and content are protected by US Copyright law and various intellectual property laws. Modification, copying or sharing of any content constitutes a breach of Copyright.

By purchasing Design Procademy products, you acknowledge that you may use this product for personal use or limited professional use. By purchasing Design Procademy products, you do not gain ownership, nor can you claim any product as your own.

You are not allowed to modify, share, sell, transfer, copy or gift the right to use these actions to anyone else. This product should, under no circumstance, be posted or uploaded to the Internet. Posting a link for others to download Design Procademy products is a felony.

This product may only be installed on a computer directly owned by the purchaser. The created with these products may only be used for personal or professional projects. Any products given to a client must be in a non-editable file format.

It is expected that the purchaser will back up his/her own products and Pro Packs on an external storage device. Design Procademy is not responsible for lost files for any reason, but may be willing to re-issue the product once a valid purchase receipt has been provided. Design Procademy is not responsible for any direct or indirect loss/damage arising from the use of our products in whatever form.

All digital sales are final sales. There are no refunds or returns.

Design Procademy reserves the right to modify the Terms of Service and Use at any time.

Design Procademy operates DesignProcademy.com (“Site”) and may operate other websites.

By using or accessing the Service (defined below), you acknowledge that you have read, understood, and agree to be bound to all the terms and conditions of this Privacy Policy, and the “Terms of Use” or other customer agreement between you and Design Procademy that is applicable to the particular Service you are using or accessing (collectively, “User Agreements”).

If you do not agree to this Privacy Policy and the applicable User Agreement, please exit, and do not access or use, the Service.

 

TYPES OF PERSONAL DATA WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for delivery of downloads via email, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

We mainly use the Order Information for confirmation purposes.

We share your Personal Information with third parties to help us use your Personal Information, as described above.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

MINORS

The Site is not intended for individuals under the age of 18.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

BUSINESS TRANSFERS

If Design Procademy, or substantially all of its assets, were acquired, or in the unlikely event that Design Procademy goes out of business or enters bankruptcy, user information would be one of the assets that are transferred or acquired by a third party. You acknowledge that such transfers may occur and that any acquirer of Design Procademy may continue to use your personal information as set forth in this policy.

We work to protect the security of your information during transmission by using Secure Socket Layer (SSL) by DigiCert. When you place an order online, the SSL scrambles and encrypts your information before it is sent to us over the Internet. This protects your personal and credit card information from being read while it is transferred through cyberspace. Information exchanged with any address beginning with https is encrypted using SSL before transmission. After your order is placed, your credit card information remains encrypted at all times. We are never able to view your complete credit card information.

Fair Credit Billing Act

It is important to remember that you are protected by the Fair Credit Billing Act when shopping online as well. Under the Fair Credit Billing Act, your bank or credit card company cannot legally hold you liable for more than $50.00 worth of fraudulent charges. The FCBA settlement procedures apply only to disputes about “billing errors.” For example:

  • Unauthorized charges. Federal law limits your responsibility for unauthorized charges to $50.
  • Charges that list the wrong date or amount.
  • Charges for goods and services you didn’t accept or weren’t delivered as agreed.

In the unfortunate event that your credit card is used without your authorization, you must notify your credit card provider in accordance with their reporting rules and procedures.
